CTM Labs LLC: End User License Agreement

This End User License Agreement is provided by CTM Labs LLC (doing business as Cognition Through Motion).

This End User License Agreement (Agreement) is a binding legal contract between you (the User) and CTM Labs LLC (Licensor, we, or us) regarding the use of our mobile applications, including Habitz On Track! and InneRConnect, and their companions (collectively, the Service).

By downloading, installing, or using the Service, you agree to be bound by the terms of this Agreement.

1. ACKNOWLEDGMENT

Licensor and the User acknowledge that this Agreement is concluded between Licensor and the User only, and not with Apple, Inc. (Apple). CTM Labs LLC, not Apple, is solely responsible for the Service and the content thereof.

2. SCOPE OF LICENSE

Licensor grants you a personal, non-exclusive, non-transferable, non-sublicensable license to use the Service on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. AI-ASSISTED DEVELOPMENT

You acknowledge that the Service was developed with the assistance of Artificial Intelligence logic. Licensor strives for high-quality technical architecture, but the Service is provided AS IS. Licensor does not warrant that the code is free of technical errors or unexpected behavior resulting from AI-generated logic. You use the Service and its local sync features at your own risk.

4. APP-SPECIFIC WARRANTY AND SAFETY LIMITATIONS

General Limitation: CTM Labs LLC is not responsible for any health, safety, or life outcomes resulting from the use or misuse of the Service.

Habitz On Track! (Productivity and Habit Tracking):

Not for Medical Use: The Service must not be used to track medication, medical treatments, or any habit where a failure of the software (including sync delays between devices) could result in physical harm or a health crisis.

InneRConnect (Wellness and Meditation):

Not a Medical Device: InneRConnect is a tool for wellness and meditation. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Visual and Audio Safety: InneRConnect features procedurally generated 3D environments that include high-contrast geometric patterns and bloom lighting effects. These visual elements may trigger discomfort or seizures for individuals with photosensitive epilepsy. This app utilizes binaural beats and specific sound frequencies intended to support a deeper meditative state and enhance your relaxation experience. If you have a history of seizures, epilepsy, or serious mental health conditions, consult your physician before using binaural audio. Never use the audio features of InneRConnect while driving, operating heavy machinery, or in any situation where full external awareness is required for safety.

Not a Breathing Pacer: The immersive environments operate on a continuous 10-minute visual cycle. The animation is an atmospheric backdrop, not a breathing pacer. Breathe naturally and let the visuals set the ambiance.

5. TECHNICAL DEPENDENCIES AND DATA

Local Storage: You acknowledge that the Service utilizes a Privacy-First local storage model. Licensor does not maintain backend backups of your data. Deleting the App or hardware failure will result in permanent data loss.

Habitz On Track!: Data syncing between devices (e.g., iPhone to Apple Watch) is a local peer-to-peer function utilizing Apple's WatchConnectivity framework. The app incorporates third-party software, including Google AdMob. Your use is subject to the privacy and tracking terms of these providers.

InneRConnect: The application operates fully offline once installed and any in-app purchases have been transacted. There is no analytics SDK, no crash reporting SDK, no advertising SDK, and no third-party framework that initiates network activity in the InneRConnect application.

6. MAINTENANCE AND SUPPORT

CTM Labs LLC is solely responsible for providing any maintenance and support services with respect to the Service. Licensor and the User acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.

7. WARRANTY AND LIMITATION OF LIABILITY

The Service is provided on an AS IS and AS AVAILABLE basis. To the maximum extent permitted by applicable law, Licensor disclaims all warranties. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.

8. INTELLECTUAL PROPERTY RIGHTS

The Service utilizes licensed audio assets and arrangements. Licensor and the User acknowledge that, in the event of any third-party claim that the Service or the User's possession and use of the Service infringes that third party's intellectual property rights, CTM Labs LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

9. LEGAL COMPLIANCE

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a terrorist supporting country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. If you are accessing the Service from the Philippines, nothing in this Agreement shall deprive you of the protection afforded to you by the mandatory provisions of the Consumer Act of the Philippines (Republic Act No. 7394).

10. THIRD-PARTY BENEFICIARY

Licensor and the User acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon the User's acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce the Agreement against the User as a third-party beneficiary thereof.
