This Terms of Service is provided by CTM Labs LLC (doing business as Cognition Through Motion).

Welcome to CTM Labs LLC. These Terms of Service (Terms) govern your access to and use of our website, https://cognitiontm.com (the Site), and our mobile applications, including Habitz On Track! and InneRConnect (collectively, the Service).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. ELIGIBILITY

You must be at least 13 years of age to use our Apps or Site. By using the Service, you represent and warrant that you meet this requirement.

2. DESCRIPTION OF SERVICE AND GENERAL PROVISIONS

CTM Labs LLC provides software tools designed for productivity, habit tracking, digital organization, wellness, and meditation.

AI-Assisted Development: You acknowledge that our Services are developed using Artificial Intelligence. While we strive for high-quality logic, the Service is provided for informational and personal use only.

No Professional Advice: Our software is a tool for organization and wellness, and does not provide medical, psychological, or professional health advice.

Digital Rewards: You acknowledge that Streaks, Points, or Achievements within the Service have no monetary value and cannot be exchanged for cash or real-world goods.

3. APP-SPECIFIC TERMS: Habitz On Track!

Privacy-First Architecture: The App functions without user accounts. All habit names, completion history, and schedules are stored locally on your device.

Local Data Responsibility: Because data is stored locally, we have no ability to recover your data if you delete the App, lose your device, or experience hardware failure.

Apple Watch Sync: Data synced between your iPhone and Apple Watch is transmitted peer-to-peer via Apple's WatchConnectivity framework. We do not monitor or store these transmissions.

Custom Assets: Custom habit photos are stored locally on your iPhone and do not sync to the Apple Watch due to technical and hardware constraints.

4. APP-SPECIFIC TERMS: InneRConnect

Health and Safety Notice: InneRConnect features procedurally generated 3D environments that include high-contrast geometric patterns and bloom lighting effects. While the app does not contain intentional strobe lighting, these visual elements may trigger discomfort or seizures for individuals with photosensitive epilepsy.

Binaural Audio and Sound Frequencies: This app utilizes binaural beats and specific sound frequencies intended to support a deeper meditative state and enhance your relaxation experience. If you have a history of seizures, epilepsy, or serious mental health conditions, consult your physician before using binaural audio. Never use the audio features of InneRConnect while driving, operating heavy machinery, or in any situation where full external awareness is required for safety.

Not a Breathing Pacer: The immersive environments operate on a continuous 10-minute visual cycle. The animation is an atmospheric backdrop, not a breathing pacer. Breathe naturally and let the visuals set the ambiance.

Not a Medical Device: InneRConnect is a tool for wellness and meditation. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Geographic Availability: The application is currently authorized for use only in the United States, United Kingdom, Canada, Australia, New Zealand, and the Philippines App Store storefronts. By proceeding, you acknowledge these regional service terms.

Offline Architecture: The application is fully self-contained, does not require an account, and operates fully offline once installed and any in-app purchases have been transacted.

5. PAYMENTS AND IN-APP PURCHASES

Transactions: All in-app purchases, including ad-free upgrades and non-consumable digital packs (e.g., InneRConnect visual packs), are processed entirely by the Apple App Store.

Refunds: Payments are final. Any requests for refunds must be directed to Apple Support according to their standard policies.

Persistence: Purchase records and local entitlement caches are stored in the iOS Keychain to allow for Restore Purchases functionality across devices.

6. ADVERTISEMENTS

The Service may display advertisements served by Google AdMob in supported apps (e.g., Habitz On Track!). Note: InneRConnect is completely free of advertising SDKs and does not display advertisements.

Consent: Users in Strict Regions (EU/UK/Brazil) are provided a consent screen before ads initialize.

Tracking: Personalized ads require your explicit permission via the iOS App Tracking Transparency (ATT) prompt.

7. INTELLECTUAL PROPERTY

Ownership: All rights, title, and interest in and to the Service, including the names Habitz On Track! and InneRConnect, the Cognition Through Motion brand, the unique assembly of software logic, and procedural visual environments, are the exclusive property of CTM Labs LLC. The Service includes audio assets and arrangements that are used under valid commercial license.

Restrictions: You may not modify, reverse engineer, or attempt to extract the source code of our Apps, circumvent limitations, or reproduce the visual and audio assets outside of the application.

8. LIMITATION OF LIABILITY AND NO WARRANTY

THE SERVICE IS PROVIDED ON AN AS IS AND AS AVAILABLE BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CTM LABS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES—INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST HABIT STREAKS, HARDWARE FAILURE, OR PERSONAL DISCOMFORT—ARISING FROM YOUR USE OF THE SERVICE.

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. If you are accessing the Service from the Philippines, nothing in these Terms shall deprive you of the protection afforded to you by the mandatory provisions of the Consumer Act of the Philippines (Republic Act No. 7394).

10. TERMINATION

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
